Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
Indexd.design its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements e) the resources links provided are up to date.
In no event shall we be liable for any damages arising out of the use or inability to use our website, including but not limited to damages for loss of data, loss of profits, or any other monetary loss.
In order to use certain features of our website, such as saving websites/resources to you favorites, you will need to create an account.
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trade mark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.
You may not transfer your credentials to a third person without prior permission.
Subscriptions are charged annually. Subscriptions will then auto-renew every year unless turned off at least 24 hours before the end of the current period. The subscription renewal date will always be the day immediately following the end date of your current subscription period. To stop auto-renewal, visit Indexers > Membership > Plans.
If you cancel the Paid Services before the end of your current paid up term, you will retain access to the paid features throughout the remainder of the term you purchased.
The Price includes the applicable VAT, if any. Any other duties or taxes, if any, will be for the account of the Customer.
If you wish to purchase any product or service made available through indexd.design, you may be asked to supply certain information relevant to your purchase including, without limitation, your credit card number, the expiration date of your credit card, and your billing address.
You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment methods in connection with any Purchase; and that (ii) the information you supply to us is true, correct, and complete.
The service may employ the use of third party services for the purpose of facilitating payment and the completion of purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.
We reserve the right to refuse or cancel your order if fraud or an unauthorised or illegal transaction is suspected.
If the Price for the Paid Services has not been paid in full, indexd.design may temporarily freeze the Personal Account or suspend access to some of the features on the Services. The temporary freeze or suspension from accessing some of the features on the Services will remain effective until a valid payment method is used.
Invoices will be sent to the Customer by email only, to the email address specified by the Customer in the Personal Account.
The Service is non-refundable. There will be no refunds or credits for partial months of Service.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease.

Indexd.design reserves the right, at its sole discretion, to modify or replace any part of this agreement. Your continued use of or access to the website following the posting of any changes to this agreement constitutes acceptance of those changes.
These terms and conditions shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflicts of law provisions.
